Terms & Conditions of Carriage - Services Operated on Behalf of Norfolk Air
Norfolk Air is not an airline in its own right. ALL Norfolk Air flights are operated by Norfolk Air partner airlines under comprehensive long-term charter agreements offering regular passenger transport services with either OzJet Airlines or Nauru Air Corporation Ltd trading as Our Airline, each hereafter referred to as the Operator. Both of these Operators hold Australian Air Operator Certificates issued by the Australian regulatory authorities.
1. Conditions of Contract
a. This Itinerary and Receipt does not constitute a document of carriage and in the event of any differences between it and the record of booking in the Operator's databases, the latter will prevail.
b. The Operator carries passengers on flights between Australian cities and Norfolk Island on contracts that consist of:
- these Terms and Conditions;
- The Operator's General Conditions of Carriage (Passenger and Baggage), available on request from OzJet at 1300 737 000, Our Airline at 1300 369 044 or Norfolk Air at 1300 663 913, at the OzJet website at www.ozjet.com.au, the Our Airline website at www.ourairline.com.au or the Norfolk Air website at www.norfolkair.com,
- International conventions and Australian laws; and
- The Operator's oral or written directions to passengers.
In the event of any inconsistency between these Terms and Conditions and the General Conditions of Carriage, the General Conditions of Carriage shall prevail.
- A person must present a valid Norfolk Air ticket or one of its accredited wholesaler vouchers to be carried on a flight. Mutilated or damaged tickets can in certain circumstances be replaced by Norfolk Air.
c. If the Operator issues a ticket or boarding pass for another carrier's flight, it does so only as an agent for that carrier.
d. Unless otherwise stated, a ticket is valid for one year from the issue date.
e. The Operator will use all reasonable efforts to carry you and your baggage in accordance with the date and time of the flight(s) specified, but does not guarantee it will be able to do so.
Schedules may change without notice.
f. The Operator may, without notice, substitute alternate carriers or aircraft and may alter or omit transiting ports on the ticket in the case of necessity. The Operator assumes no responsibility for making connections.
g. If due to circumstances beyond its control the Operator cancels or delays a flight or is unable to provide a previously confirmed seat, Norfolk Air shall either carry the passenger on another of its passenger flights on which space is available or make a refund of the cost of the ticket and shall be under no further liability to the passenger.
h. In the case of a weather delay, Norfolk Air and the Operator will not provide accommodation, meals or cover any other cost that may be incurred by the passenger as a result of the weather delay.
i. You must:
- comply with all applicable government travel requirements, including obtaining visas to enter the countries to which you are travelling; and
- check in by the required check-in time.
j. The contract between you and the Operator, including any exclusion or limitation of liability applies to benefit:
- the Operator's employees, agents and representatives;
- all other carriers used by the Operator to carry you; and
- those other carriers' employees, agents and representatives, and the Operator hold that benefit on trust for them, and can, if requested by them, enforce it on their behalf.
k. If your checked baggage has been lost or damaged, you must notify the Operator in writing within 7 days and in the case of delay, within 21 days of delivery. If a whole item of your checked baggage on a domestic the Operator flight has been lost or destroyed, you must notify the Operator in writing within 21 days, or if part only of an item has been damaged, lost or destroyed, within 3 days.
2. Baggage Allowances
a. Carry-On
Norfolk Air travellers are allowed one piece of baggage, not exceeding 7kg, in the aircraft cabin.
b. Checked Baggage Allowances
- Norfolk Air travellers can check in up to 20kg of baggage at Norfolk Air Check-In counters, in addition to taking one 7kg piece in the aircraft cabin.
- An additional allocation of 10kg per person will be allowed for Sporting equipment, eg. bowls, surfboards, golf clubs. Infants will be permitted up to 10kg of checked baggage. Individual pieces of checked baggage must not exceed 155 linear centimetres (62inches) being Length + Breadth + Depth.
3. Excess Baggage Charges
Baggage carried in excess of the 20kg checked baggage allowance (30kg with sporting equipment) on Norfolk Air is charged at the following rates:

Notes
The Operator is not liable for loss damage to or delay in the delivery of fragile or perishable articles, money, jewellery, precious metals, negotiable papers, securities or other valuables (including but not limited to cameras and electronic equipment), business documents or samples which are included in the passenger's checked baggage, whether with or without the knowledge of the airline. Such personal valuable items should be carried on your person or in your carry on baggage under your care.
Not withstanding the restrictions outlined above, the Operator shall be liable for damage to checked baggage only if such damage has been caused by the negligence of the Operator subject to applicable limitation provisions.
4. Domestic Notice - Limitation of Liability
Carriage wholly within Australia which is not international carriage as defined by the Warsaw Convention, is subject to the provisions of the Civil Aviation (Carriers' Liability) Act 1959 as amended or complementary State legislation. The Operator's liability in respect of the death or injury of any passenger is limited to A$500,000, and in respect of baggage is limited to A$1,600 per passenger (for checked baggage), and A$160 per passenger for cabin baggage).
5. International Notice - Limitation of Liability
If the passenger's journey involves an ultimate destination or stop in a country other than the country of departure the Warsaw Convention or the Montreal Convention may be applicable and these Conventions govern and may limit the liability of carriers for death or bodily injury and in respect of loss of or damage to baggage.
6. Seating
The Operator does not guarantee you any, or any particular, seat even if your reservation is confirmed. You must accept any seat allotted on the flight even if this involves a downgrade, or wait until the next flight on which a seat is available in the class of service paid for.
7. Overbooking Notice
There is a chance a seat will not be available on a flight even if your reservation is confirmed. This is due to the common practice in the airline industry of overbooking. Norfolk Air's policy on overbooking is available at Norfolk Air's Head Office.
8. Government and Other Taxes and Charges
Travel within Australia and Internationally - the price of your ticket may include significant amounts of taxes, charges and fees imposed on air transport by governments, authorities and airport operators (in the fare, e.g. Goods and Services Tax, or shown separately as a TAX/FEE/CHARGE). You may also be required to pay additional taxes, fees or charges not marked on your ticket.
9. Insurance
Personal and baggage insurance is recommended. Details may be obtained from Norfolk Air, the Operator, or your travel agent.
10. Searches
The Operator, government or airport officers may require you to submit to clothing and body searches, require you to submit your baggage to searches or inspections, and search or inspect your baggage with or without you.
11. Right to Refuse Carriage
The Operator reserves the right to refuse carriage to any person who seeks to travel in violation of applicable laws, tariffs or the General Conditions of Carriage, or is otherwise in breach of these Terms and Conditions, or under the influence of drugs or alcohol, or it is necessary for the safety or comfort of other passengers or for the protection of property.
12. Smoking
Smoking is not permitted on any of the Operator's aircraft.

14. Dangerous Goods
For the safety of passengers and crew, most dangerous goods are forbidden from being carried in checked or cabin baggage. Dangerous goods can be considered as, Explosives, all types of Gases under pressure, Flammable Liquids and Solids, Organic Peroxides and Oxidisers, all types of Toxic substances, Corrosive substances and Radioactive Materials. There are a few items that because of their nature are acceptable, however to ensure compliance with international regulations, and to maintain absolute safety, it is important that passengers check the Operator's website at www.ozjet.com.au, www.ourairline.com.au, Norfolk Air Contact Centre or www.norfolkair.com, Airport staff or with their travel agent regarding what items can be carried, before packing any item of dangerous goods in baggage.
